A letter of Credit is a method of payment which is most useful for international sales transactions. It is a secure way of payment between buyers and sellers. In the case where a LC is issued, banks get involved into the transaction, thus shifting the risk from the buyer to the bank. When there is documentary agreement between the seller and the buyer, the buyer issues a LC from a bank (Issuing Bank) and there is also another bank (Advising Bank) advising the LC to the seller. This means that the Letter of Credit takes the risk of the transaction with regard to the document, not the goods transaction itself. Thus, before applying for a LC, make sure that you have a number of valid documents, such as Commercial invoice, insurance document, Certificate of Origin and many others.
2 Follow the specified dates 注意信用证的有效期
There are several dates of importance specified in a LC. However, the most important one is its expiry date. This can cause problems. If LC expires sooner than the actual sale occurs, the seller is left without protection. That is why, specifying correct dates is a key point in the LC process.
3 No documentary compliance problems should exist 开证前确认好条款
The seller should make sure there are no compliance problems with documents within the Letter of Credit. Otherwise, This could be a reason for the LC to fail, leaving seller with no protection.
4 No minor error’s should exist in LC formulation 信用证上不许犯任何细节错误
The documents must be 100% accurate. Even a small typo may result in the loss of the Letter of Credit power and the seller can be left unprotected. Thus, you should start the LC process as early as possible to have enough time to properly draft the documents and revise any issues found.
5 Regulations on LC vary across countries 国家间的信用证要求和规定也许会不一样
In some countries the regulations require strict compliance with documentary requirements. It is important to fully understand the specific requirements and regulations of the given country to prepare the LC accordingly.
