他没续约，所以应该是属于month to month。租客只需给一个月通知。

比如，每月1号交租，今天是6号，今天或4月1号之前通知的话最早四月底才能搬。没有免租也不用罚。两清。

租约分2种， 一种是Month by month , 一种是每年到期再续约的固定合约， 固定合约有一个很明显的地方是租客必须在一个条款; 到期后搬出该出租单位哪里签名， 当然如果你愿意的话可以和他renew ， 如果比不愿意， 就按合同走， 他必须在到期日的中午1点前搬出去
