CLAUSE 7: PAYMENT:Buyer shall open within 7 bank working days after signing of the contract, from a 1st class international bank, an irrevocable, non transferable, Letter of Credit through internationally reputed bank without recourse to drawer 90days Letter of Credit in favour of Seller for an amount in US Dollars sufficient to cover 100% (One hundred percent) of the shipment value providing for payment of 95% (Ninety Five percent) of the Seller’s provisional invoice value 90 days after sight against proof of shipment to the seller bank. All banking charges outside Opening bank shall be paid by the Seller and LC shall be valid for 120 days. If L/C validity has expired before Final payment received by Seller, Buyer shall extend the L/C to Seller until all payment has been settled.
A. PROVISIONAL PAYMENT
The said LC shall be payable by telegraphic transfer payment by opening bank against seller’s 90 days draft for the amount of 95% (Ninety Five percent) of the CFR purchase value of the shipment accompanied by the documents as stipulated in clause 8. The weight certificate issued by qualified surveyor by survey of ship’s draft together with the certificate of analysis of sample and of the percentage of the free moisture loss at 105 degree centigrade issued by qualified surveyor at the loading port shall be the basis for seller’s provisional invoice.
B. FINAL PAYMENT
The final valuation of the cargo to be calculated based on CIQ’s certificate as provided in the clause 9 and 10 issued within 60 days after completion of discharging. In case CIQ’s certificates are not provided by Buyer to Seller within 90 days after discharging date, the load port result on quality and quantity shall be the basis for final valuation.
