My advice would be to send in everything anyway. There undoubtedly will be a class-action lawsuit arising out of the legislation. So, better to be one step ahead of others than to do nothing.My own view is (a) the legislation will pass unless the Government withdraws it because the Conservatives have a clear majority in the House and (b) the legislation would be lawful because the Government has the right to decide whom it will admit to Canada. However, that is only the beginning. The Government has the right to cancel contracts but may be liable for damages for having done so. If the Court agrees that damages may be awarded, CIC might change its tune. By submitting all the documents, etc., s/he will be able to prove that CIC was poised to assess the file before cancelling it, putting him/her in a stronger position than some others.Once we have the order for the application, I expect to file action for damages for our lead litigant. If the Court does not dismiss the case, CIC will realize that it risks suits from all those whose files it has threatened to close and might back down. We'll see.
