A California battery is simply this: "any willful and unlawful use of force or violence upon another person." Penal Code 242 is known as a “wobbler”. Because of the special consideration afforded to officers and other types of "civil servants", you face a greater jail or prison sentence and potentially higher fines if convicted of battering such a person.The Difference between "Assault" & "Battery"Assault (defined under California Penal Code 240) and battery (Penal Code 242) are actually two separate crimes although they are often used interchangeably.A battery requires some type of violent, painful, or offensive physical contact.An assault, on the other hand, may be charged when an attempt to injure another is made. No physical contact is actually necessary to be charged with an assault.
